Abstract

La paulatina juridificación del campo ambiental dene efectos importantes en la relación entre gobierno y sociedad. Las leyes y reglamentos ambientales implican la creación de organismos gubernamentales para prever, regular y gestionar las consecuencias de la actividad humana en el entorno ecológico. Además, dicho "corpus" jurídico originó conflictos sociales por presuntas omisiones y violaciones de los ordenamientos ambientales. En Matamoros se dio el caso de un diferendo legal que, a1 principio, estuvo ligado a la tenencia del suelo, y que tras la sistematización de las leyes ambientales ha adquirido los perfiles de una querella ambientalista. Esto nos permite sugerir que la legislación ambiental: induce la formación de un campo específico de conflictos sociales, es un surtidor de actores sociales que no existían y tiende a conformar un tipo específico de legitimidad en los conflictos sociales que induce.

 


ABSTRACT

 

The gradual juridification of the environmental field has important consequences in the relationship between society and government. Environmental laws and regulations involve the creation of governmental organizations in charge of preventing, regulating and managing the consequences of human activities on the environment. And such judicial body has allowed the emergence of specific social conflicts, which are centered in presumed omissions and violations to environmental ordinances. In Matamoros we have a legal case that was, at the beginning, linked to land ownership, but which has, since the appearance and sis-tematization of environmental laws, acquired the features of an environmental quarrel. This suggest us that environmental legislation leads to the formation of a field of social conflicts, provides certain social actors who did not exist and tends to conform a kind of legitimacy in the social conflicts it causes.
